Resumo

Resumo: Este artigo tem por objeto os direitos humanos e objetiva apontar o porquê de os direitos humanos não poderem ser considerados naturais, tampouco universais. O artigo irá problematizar, em primeiro lugar, a suposta naturalidade direitos humanos. Para tanto, será apresentada a concepção dos direitos humanos como produtos culturais ocidentais. Sequencialmente, será utilizada a crítica de Kelsen contra a naturalidade e universalidade dos direitos humanos. Finalmente, será abordada a questão de que não há contraposição entre dos direitos humanos universais e os diversos localismos culturais. Se os direitos humanos universalistas não podem ser considerados naturais e universais, eles devem ser considerados um culturalismo ocidental, que foi universalizado por meio de normativas internacionais. Dessa maneira, sendo um culturalismo, ele não se opõe aos demais localismos culturais.

Abstract: This article aims the human rights and objects investigate why human rights are not natural nor universal. The article will discuss, first the fact that human rights are considered natural. Therefore, the concept of human rights as a Western cultural products will be presented. Sequentially, the criticism of Kelsen against naturalness and universality of human rights will be used. Finally, we will address the issue that there is no opposition between universal human rights and the different cultural localism. If universal human rights can not be considered natural and universal, they are a western culturalism that was universalized by international standards. Thus, as aculturalism, human rights are not opposed to other cultural localism rights for human.
